Step 2
With the assistance of an immigration lawyer, the EB-5 investor files the I-526E Petition
• The EB-5 investor executes the subscription agreement and wires his/her EB-5 investment capital to escrow.
• Due to a recent and important policy shift, if the EB-5 investor is physically present in the United States on a valid non-immigrant visa, and meets eligibility requirements, he/she can file for U.S. residency concurrently with the I-526E, enabling them to obtain much faster work and travel authorization during the EB-5 adjudication process. In addition, by filing concurrently, applicants no longer need to depart the U.S. to secure their green card, minimizing disruptions to their professional and personal lives.
Step 3
After I-526E Petition Approval, the EB-5 investor files to become a U.S. Conditional Permanent Resident
Step 4
The EB-5 investor is a U.S. Conditional Permanent Resident for two years, enjoying all of the same rights as a Permanent Resident
Near the end of the two-year period of conditional residency, the EB-5 investor files an I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, and that of any dependents.
Once the Petition is filed, the investor is eligible for the return of his/her EB-5 investment capital.
Step 5
Path to U.S. Permanent Residency and Naturalization
Once the I-829 Petition is approved, the EB-5 investor becomes a U.S. permanent resident and may petition for naturalization in approximately 5 years after acquiring conditional residence
